Do I have to be unemployed to file bankruptcy?

You do not have to be unemployed to file for bankruptcy protection. The law does require the debtor to go through the “means test” to determine what type of bankruptcy, Chapter 7 or Chapter 13, he or she may be eligible to file. The purpose of the means test is not to prevent a consumer from filing bankruptcy, but is rather used to determine which type of bankruptcy is appropriate. In the case of a Chapter 13 Bankruptcy, having a job, or other regular income, is critical to being able to fund a Chapter 13 Plan.
